Patterson Law Wins Landmark Expropriation Ruling

The Nova Scotia Utility and Review Board’s ruling in favour of Wayne Oakley was the first of its kind in Nova Scotia. Lead Lawyer Rob Pineo and his team were successful in arguing that Mr. Oakley suffered damages and loss prior to the actual expropriation of his land. In this landmark ruling, the NS UARB awarded compensation to the Moose River landowner for the “disturbance” to his life; it is the first decision in Canada that applies the 15% of fair market value default valuation for disturbance damages for a home taking.
